TERMS OF SERVICE

1.1 These Terms of Service ("Terms") govern your access to and use of the services provided by Infinite Reach Creative "Thoroughfare Design" (referred to as "Company," "we," "us," or "our"). By accessing or using our website (http://www.thoroughfaredesign.com) and any related services, you agree to these Terms.

1.2 Scope of Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding your use of our services.

2. Definitions

2.1 Services: Refers to the services provided by the Company, including but not limited to the sale of semi-custom premade brands and related design services.

2.2 Products: Refers to the semi-custom premade brands and design files offered for sale by the Company.

3. Independent Contractor and Non-Exclusivity

3.1 Independent Contractor: The relationship between you and the Company is that of an independent contractor. Nothing in these Terms shall be construed to create a partnership, joint venture, agency, or employment relationship between the parties.

3.2 Non-Exclusivity: This Agreement does not create an exclusive relationship between the parties. Client is free to engage others to perform Services of the same or similar nature to those provided by Designer, and Designer shall be entitled to offer and provide design Services to others, solicit other Clients, and otherwise advertise the Services offered by Designer.

3.3 Competing: The Client may not use the Services or Products to compete with Infinite Reach Creative “Thoroughfare Design by way of commercial enterprise or a revenue-generating endeavor.

4. Products and Services

4.1 Product Description: Our Products are semi-custom premade brands that are sold a limited number of times. Each purchase includes one revision, and additional revisions are billed at $250 per hour.

4.2 Design Files: Clients are not permitted to edit, modify, or distribute the design files provided by us without explicit permission.

4.3 Limited License: Purchases grant a limited, non-transferable license to use the Products for their intended purpose for one business ONLY. This license does not grant the right to trademark the designs, claim ownership of the intellectual property, or for usage across more than one business.

4.4 Revoking License: If the Client exceeds the intended use of the Services or Products, the Designer will revoke immediate use and licensing of the Services and Products. Client will cease use of the Product or Services.

4.5 Making Copies: Client shall not create copies of any Services or Products and provide access to a third party, other persons, or other entities. Client may not copy or re-distribute the Services or Products.


5. Purchases and Payments

5.1 Availability: Products are subject to availability, and we reserve the right to discontinue any Product at any time.

5.2 Prices and Payment: Prices are subject to change. Client agrees to provide accurate payment information and authorize us to charge the Client’s chosen payment method for purchases.

5.3 Refunds: All sales are final, and refunds will not be issued except as required by law.

6. User Conduct

6.1 Compliance: By using our Services, Client agrees to comply with these Terms and all applicable laws and regulations.

6.2 Prohibited Activities: Client may not engage in any prohibited activities, including unauthorized use of the Products, commercial use without approval, or sharing of Products with third parties.

7. Promotion

7.1 Usage for Promotion: We retain the right to reproduce, publish, and display the Products for promotional purposes, including in our portfolios, websites, design periodicals, and other media.

8. Limitation of Liability

8.1 Disclaimer: To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Products and Services.

8.2 Limitation of Liability: In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from Client’s access to or use of the Products and Services.

9. Governing Law

9.1 Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
